What this Agreement Covers
This Agreement governs your use of the Site and the EMPOWERMENTWEARLLC.com service (the “Service”). The Service permits customers that have an appropriate relationship either with: (i) institutions of higher learning, fraternal organizations, honor societies and other collegiate groups (collectively, “Institutions”); (ii) corporations and small businesses; (iii) elementary and secondary schools; or (iv) other organizations, to design and purchase custom merchandise properly describing that relationship. You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.
Intellectual Property Rights of EMPOWERMENTWEARLLC.com and Third Parties
EMPOWERMENTWEARLLC.com is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the EMPOWERMENTWEARLLC.com Site (collectively the “Contents”) are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by EMPOWERMENTWEARLLC.com.
EMPOWERMENTWEARLLC.com is the owner of the EMPOWERMENTWEARLLC trademark; other trademarks made available through this Site, including logos, slogans, color schemes and design trademarks, are licensed for use by EMPOWERMENTWEARLLC.com from Institutions and other third parties (the “Licensed Marks”). By using the EMPOWERMENTWEARLLC.com Site, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use and access of the Licensed Marks by the third parties. EMPOWERMENTWEARLLC.com will notify you of such terms if your age is in violation of such terms.
Generally, products created using images available on the site should not be resold commercially. In the event that you wish to resell such products, you agree to contact EMPOWERMENTWEARLLC.com and verify the legality of reselling such products prior to doing so. Designs created using the text tools and images available through the site are in no way the exclusive property of the customers who assemble such designs. EMPOWERMENTWEARLLC.com retains the right to display such designs or offer them (or variations of such designs) to other customers.
Additionally, EMPOWERMENTWEARLLC.com has the sole discretion to reject any order that it considers libelous, defamatory, obscene, profane (according to standards established by the FCC), portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, religion, disability or national origin, containing explicit sexual content or is otherwise inappropriate for EMPOWERMENTWEARLLC.com production.
You agree to not use EMPOWERMENTWEARLLC.com’s Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party.
Anti-obscenity Policy
At EMPOWERMENTWEARLLCwe believe in freedom of expression. However, we offer our services as a way to spread love and positivity around the world. Our customers come from many places around the globe who may disagree about what is offensive and what is not. EMPOWERMENTWEARLLC will determine, in its sole and absolute discretion, whether your images are appropriate or allowable. We ask that all of our customers use their best judgment when uploading images or adding text to an EMPOWERMENTWEARLLC t-shirt. Any content that is determined to be offensive or inappropriate is subject to removal in accordance with the EMPOWERMENTWEARLLC Terms of Service and Anti-Obscenity Policy contained herein.
The list outlined below should NOT be construed as an exhaustive list of offensive material but rather as a general guideline for you to follow. General types of content that are prohibited on EMPOWERMENTWEARLLC include but are not limited to:
Content that may infringe on the rights of a third a party
Items that make inappropriate use of Nazi symbols and glamorize the actions of Hitler
Use of marks that signify hate towards another group of people
Hate and/or racist terms
Inappropriate content or nudity that is not artistic in nature
Content that exploits images or the likeness of minors
Obscene and vulgar comments and offensive remarks that harass, threaten, defame or abuse others such as F*** (Ethnic Group)
Content that depicts violence, is obscene, abusive, fraudulent or threatening such as an image of a murder victim, morgue shots, promotion of suicide, etc.
Content that glamorizes the use of “hard core” illegal substance and drugs such as a person injecting a vial of a substance in their body
Material that is generally offensive or in bad taste, as determined by LY?MY
Changes to this Terms of Service Agreement
EMPOWERMENTWEARLLC has the discretion to update this privacy policy at any time. When we do, post a notification on the main page of our Site, revise the updated date at the bottom of this page,. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
